The Agreement applies to You whether You are -
A patient, his/her representatives, searching for Practitioners through the Website (“End-User”, “You” or “User”); or
Otherwise a user of the Website (“You” or “User”).
This Agreement applies to those Services made available by Adheeti on the Website (“Services”), including but not limited to the following:
For Users: Facility to (i) create and maintain ‘Health Accounts’, (ii) search for Practitioners by name, specialty, or any other criteria that may be developed and made available by Adheeti, and (iii) to make appointments with Practitioners, (iv) Online Consultations with qualified practitioners of Adheeti, (v) Delivery of doctor-prescribed medicines, (vi) Follow-up Services, (vii) Patient data storage Service, (viii) Online Yoga coaching, (ix) Other Services as may be intimated from time to time.
The Services may change from time to time, at the sole discretion of Adheeti, and the Agreement will apply to Your visit to and Your use of the Website to avail the Service, as well as to all information provided by You on the Website at any given point in time.
This Agreement defines the Terms and Conditions under which You are allowed to use the Website, avail the Services and describes the manner in which we shall treat Your account while You are registered as an User with us.
By downloading or accessing the Website to use the Services, You irrevocably accept all the Conditions stipulated in this Agreement, and agree to abide by them.
This Agreement supersedes all previous oral and written Terms and Conditions (if any) communicated to You relating to Your use of the Website to avail the Services. By availing any Service, You signify Your acceptance of the Terms of this Agreement.

Your access to use of the Website and the Services will be solely at the discretion of Adheeti.

By registering, visiting and using the Website or accepting this Agreement, You represent and warrant to Adheeti that You are 18 years of age or older, and that You have the right, authority and capacity to use the Website and the Services available through the Website, and agree to and abide by this Agreement.
As a Primary User, You can use the Services for the minors with the express understanding that the Primary Member shall be entirely responsible and liable on all counts for compliance with these Adheeti Terms for and on behalf of such minor who is below the age of majority.
By registering, visiting and using the Website for availing the Adheeti Service or accepting these Terms and the Standard Policies, You represent and warrant to Adheeti that You are eighteen (18) years of age or older and have the appropriate authorization to contract on behalf of a minor who is below the age of majority, and that You have the right, authority and capacity to use the Website for availing the Service and agree to and abide by these Terms.
You are advised not to use online consultation Services of Adheeti in case of medical emergencies such as accidents, bleeding injuries, burns, sexual abuse/assault, medicolegal cases, or if You are in critical Condition.
If You are a Registered User or User but do not meet the above pre-Conditions, please do not avail of the online consultation Services. Adheeti will not be responsible or liable for any harm or loss that You may suffer if You elect to access these Services.
All Users who are patients and opt for online consultation Services may be required to undergo an initial medical examination to ascertain and record medical history, medication history, and medical status before video-consulting support can be provided.
Online consultation Services are provided with the express consent of the User and are not a replacement for physical consultation. These Services are meant for general consultation only.
If, after an online consultation, it is recommended to undergo any diagnostic tests or if You are issued a Prescription, these are provided based on preliminary examination, and hence should not be treated as accurate, final, and conclusive.
Adheeti reserves the right to modify the Prescription or recommended diagnostic tests if the User provides additional information in future consultations.
Payments for Consultations and services must be made in full before commencement.
Refunds will only be processed as per the Adheetil’s refund policy, available on request.
Additional costs for medicines, courier, or other special charges will be communicated separately.
Adheeti takes Your online Privacy very seriously and follows all reasonable steps to maintain online Privacy standards and practices that are relevant to the times. Adheeti respects Your online Privacy and understands Your need for protecting any personally identifiable information (“Personal Information”) You share with us.
You have the option of uploading Your identifiable health information, including physical, physiological, and mental health Conditions, as well as medical records and history, onto the Application. This information may be accessed by Adheeti during the course of providing Services to You.
If You are a Secondary User, Your information may be provided to us by the Primary User under whose account You are using and accessing the Application and Services. If You have not lawfully authorized the Primary User to do so, please contact us immediately. By continuing to access and use the Application and Service, You confirm that You, as a Secondary User, have authorized the Primary User to provide Your information to us.
Based on the information provided by the Primary User, the Adheeti care team, doctors generate the prescription in the Secondary User’s name. We may collect various personal information from You when You use the Website and its features.
Adheeti may disclose/transfer Your personal information in accordance with applicable law and for the purposes outlined in the Privacy Policy.
Adheeti is required by law to maintain the Privacy and confidentiality of Your medical information. We are committed to taking Your Privacy seriously and to maintaining the confidentiality of the information You provide to us. However, we do not represent, warrant, or guarantee that our safeguards to prevent unauthorized access to Your personal information are foolproof.
Adheeti may provide End-Users with a free facility known as ‘Records’ on its Website. Information available in Your Records is of two types:
i. User-created: Information uploaded by You or information generated during Your interaction with the Adheeti ecosystem, eg: appointment, registration.
ii. Practice-created: Health Records generated by Your interaction with a Practitioner during consultation.
The specific Terms relating to such Health Account are as below, without prejudice to the rest of these Terms and the Privacy Policy:
Your Records are only created after You have signed up and explicitly accepted these Terms.
Any Practice created Health Record is provided on an as-is basis at the sole intent, risk and responsibility of the Adheeti does not validate the said information and makes no representation in connection therewith.
You should contact Adheeti in case You wish to point out any discrepancies or add, delete, or modify the Health Record in any manner.
The Health Records are provided on an as-is basis. While we strive to maintain the highest levels of Service availability, Adheeti is not liable for any interruption that may be caused to Your access to the Services.
Adheeti has the ability in its sole discretion to retract Health Records without any prior notice if they are found to be shared incorrectly or inadvertently.
Adheeti will follow the law of land in case any constitutional court or jurisdiction mandates to share the Health Records for any reason.
If You access Your dependents’ Health Records by registering Your dependents with Your own Records, You are deemed to be responsible for the Health Records of Your dependents and all obligations that Your dependents would have had, had they maintained their own separate individual Records. You agree that it shall be Your sole responsibility to obtain prior consent of Your dependent and shall have the right to share, upload and publish any sensitive personal information of Your dependent. Adheeti assumes no responsibility for any claim, dispute or liability arising in this regard, and You shall indemnify Adheeti and its officers against any such claim or liability arising out of unauthorized use of such information.
User shall not modify the Adheeti Content or reproduce, display, publicly perform, distribute, or otherwise use the Adheeti Content in any way for any public or commercial purpose or for personal gain.
User shall not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
You agree that this Agreement and any contractual obligation between Adheeti and User will be governed by the laws of India.
Adheeti, located at Mattarakkal, in Kerala, India owns and operates this Site. Those who access the Site from other locations do so on their responsibility as regards complying with local laws as applicable.
Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or Your use of the Website or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by Adheeti. The seat of such arbitration shall be decided by Adheeti. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.

Users may expect the anticipated benefits from the Services provided by Adheeti, but no results can be guaranteed. A User’s Condition may not be cured or improved, and in some cases, may worsen.
Specifically, Adheeti disclaims any liability arising out of: 1. Any pre-existing medical Condition; or 2. Any adverse reaction (due to any act or omission based on information found on the Application, or otherwise); or 3. Sudden escalation of a prior medical Condition or medical situations that occur due to the omission of critical and material health information by a User.
